Suspected rapist, killer pleads not guilty

Jose Manuel Garcia Guevara spoke only a few words of Spanish at his arraignment in state district court Friday.

Guevara, the most recent capture of the FBI’s Ten Most Wanted, is charged with second-degree murder, aggravated rape and aggravated burglary in the February 2008 death of his neighbor, 26-year-old Wanda Barton.

The court proceedings were relayed to Guevara through an interpreter, who will also be available so that Guevara can communicate with his attorney, Robert Shelton. The interpreter will be paid out of the court’s jury and witness fee fund, Judge David Ritchie said.

Shelton entered a not guilty plea on behalf of Guevara, and a trial date was set for Jan. 26. Normally, a pretrial conference would have been scheduled, but “the matter likely won’t be resolved in a pretrial conference,” prosecutor Rick Bryant said.

He said he turned over all discovery material, including 16 discs of videotaped statements. A videotaped statement from Barton’s 4-year-old son, who was present in the home when the killing occurred, wasn’t turned over, but will be available to Shelton for viewing.

“We gave more than required … to expedite this case,” Bryant said.

At the end of the hearing, Shelton asked Guevara through the interpreter, “Do you understand everything that’s transpired here today?”

“Sí,” Guevara replied.

Guevara was scheduled to be arraigned Monday, but it was postponed because Shelton was not present.

Guevara was arraigned just over two weeks after he was returned to Calcasieu from his native Mexico.

Authorities believed that Guevara had returned to his hometown of Rioverde, San Luis Potisi, but it wasn’t until he was placed on the Ten Most Wanted list that the wheels began turning to capture him.
