Judge tosses woman's "too fat to fly" lawsuit

NEW ORLEANS (AP) — A federal judge has dismissed a lawsuit filed against Southwest Airlines by a New Orleans woman who claims a gate agent told her she was "too fat to fly" and couldn't board a flight last year without buying two tickets.
In her order Wednesday, U.S. District Judge Susie Morgan said she dismissed Kenlie Tiggeman's suit because she hasn't responded to Southwest's request for the case to be tossed. Morgan also said the airline's request "appears to have merit."
Tiggeman declined to comment on Morgan's ruling. She was interviewed about her claims on NBC's "Today Show" after she sued.
Her suit claims airline employees discriminated against her because of her obesity. She says she weighed up to 300 pounds at the time she tried to board an April 2011 flight.
