Thibodaux City Council rejects saggy pants law

THIBODAUX (AP) — The Thibodaux City Council has rejected a measure that would have banned saggy pants in the city.

The Daily Comet reported council members and city residents debated the morality and legality of the measure for more than 45 minutes Tuesday before delivering a 3-2 vote.

Some residents argued against the measure because of its questionable legality and how it may affect the community.

Thibodaux resident Ben Harang said the measure would be a violation of the First Amendment protection of expression.

“What’s to stop you from telling me I can’t wear a pink shirt? The city has more important things to do than this,” Harang said.

City Attorney Beau Brooks advised the council to be wary of the measure’s questionable legality.

“Clearly there exists a constitutional issue with this. Does the council want to subject the city to a potential lawsuit?” he said.

Critics maintain that saggy pants laws violate Americans’ constitutional right to free expression.

Terrebonne outlawed saggy pants in April. Terrebonne Parish Council Chairwoman Beryl Amedee was the only member who voted against the ordinance, claiming it violates the constitutional right to free expression.

The Lafourche Parish Council passed its ban in 2007.
