Man accused of cruelty to a juvenile to remain in jail until trial

Judge Clayton Davis on Friday ruled that a Lake Charles man accused of cruelty to a juvenile cannot be released from jail while he awaits his October trial.

Murry Day is charged with one count of second-degree cruelty to a juvenile and two counts of cruelty to a juvenile. His wife, Jaime Day, is charged with three counts of second-degree cruelty to a juvenile and five counts of cruelty to a juvenile.

The Days were arrested in March 2009 after a deputy investigated a complaint that Murry Day’s 9-year-old son was malnourished and confined to a room.

Deputy Jason Schnake found the boy in a room with a dog leash tied across the doorway, Calcasieu Parish Sheriff’s Office spokeswoman Kim Myers said. He weighed about 38 pounds and was lying on a foam pallet atop a box-spring mattress covered in blood and human excrement, she said. He was reportedly wearing a T-shirt, shorts and a diaper. 

The child was injured, with multiple bruises on his body and a second-degree burn mark on his back, Myers said. He reportedly spent 13 days in the hospital suffering from hypothermia due to malnutrition.

There were two other children in the home, but deputies determined that neither of them had been abused. All three children were removed from the home.

On Friday, Murry Day’s attorney, Ralph Williams, said Day was put in jail because he missed court dates, but his client “gets the message” now.

Williams said Day is suffering from health problems and needs to be hospitalized. If he were to be released pending trial, he would have time to seek the appropriate medical attention, Williams said.

Prosecutor Cynthia Guillory said Davis previously ordered the defendant to be incarcerated until his trial after he missed court twice. She said that when Day was out on bond, he had contact with Jaime, a direct violation of his bond conditions.

“He’s clearly showed that he isn’t taking this seriously,” she said.

Davis said he would not change his ruling, and Day will remain in jail until his Oct. 29 trial. His bond was previously reduced from $2 million to $120,000.

Jaime Day faces trial on the same day, and is out of jail on a $250,000 bond, reduced from the original amount of $5.5 million.

Will the trial actually start tomorrow? Probably not, but its still the Fact that Calcasieu is Ass backwards. Jaime locked kid up & beat him.. She is FREE & Out n Society with a Child n her posession & Murry is locked up? Wow!
They should BOTH B LOCKED UP FOR THE VIOLATION OF BEING TOGETHER & not taking it seriously. If that applys for him. It should for HER TOO!

I have personally seen this guy at 2 different area bars in the past 2 yrs. I guess his "medical problems " relate!
