Lake Charles man charged with fourth-offense DWI

A 39-year-old Lake Charles man was arrested Thursday and charged with fourth-offense DWI, state police said.

Sgt. James Anderson, Troop D spokesman, said John A. Hernandez was pulled over between Lake Charles and Iowa.

Hernandez was charged with vehicular homicide in 2006 but the charges were later dropped.

According to reports at the time, authorities alleged Hernandez was following the truck of Johnathon Wilson, 33, when he rear-ended Wilson and caused a three-vehicle crash. Wilson was pronounced dead at the scene.

On Thursday, troopers responding to reports of a reckless driver "observed traffic violations including nearly hitting the vehicle ahead,” Anderson said.

Anderson said it is believed Hernandez was under the influence of narcotics.

Tests will be submitted to the Louisiana State Police Crime Lab, Anderson said.

Hernandez was arrested on DWI charges twice in 2011, Anderson said.

Wilson was a friend of Hernandez according to a state trooper’s report filed in court documents.

Prescription drugs were found in the toxicology tests of both Hernandez and Wilson, according to lab reports filed with the court.

According to the state trooper’s report, Hernandez said he had been to Houston that morning to obtain prescriptions for Soma and hydrocodone. The report also said Hernandez claimed he had given pills to Wilson.

In 2008, Hernandez agreed to spend two years at the Academy of Training Skills and charges were dropped.

Wilson’s mother spoke at the hearing, according to court documents.

This crap continues because the voting public tolerate these pitiful DA's & Judges who are not AFRAID of voters... Additionally, it is YOU the voters who are paying for a sub-standard judicial system...!!!
Enlighten your legal system that You will no longer accept BS plea-bargaining...!!!
Let the charges filed be prosecuted on their merit & You'll soon begin to see a change...
It takes a willing prosecutor & an unwavering judge...!!!

Just wanted to also add that I don't understand what the significance of his DUI that I spoke at the hearing. I did spoke to get him the help that he needed. He was my son's best friend and like a second son to me. I did not want his life to be over too. He had small children and they would also be without a father like my two grandchildren are now. I spoke to get him the help he needed to recover from the addiction. I did not speak to make light of what had happened.

Phyllis Wilson - Mother of Johnathon Wilson. Get your facts straight. The charges were not dropped. He accepted a lesser plea in order to accept the two year stay in Lacassine. It was then that after the two years that the negligent homocide charge would be reduced to first time DWI. When will it end. How many other people will be kiilled. Our police officers keep picking up these people and they do not have anything happen. It is seven years since my son was killed and his friend is still driving while taking drugs. Someone help me to understand how this can go on
