Judge to review personnel records of CPSO deputies

A judge in state district court said he will look at personnel records of detectives who investigated a woman for child abuse in 2007 and 2009.

Jasmine Elizabeth Stanley, 28, pleaded guilty in 2010 to two counts of second-degree cruelty to a juvenile and was sentenced to 12 years in prison, but the plea was thrown out because of ineffective counsel. She entered an Alford plea, which allowed her to plead guilty while not admitting to the crime.

She is accused of abusing her daughter in 2007, when the child was 2 months old, causing skull fractures and other broken bones. Her children were returned to her care in December 2008. In February 2009, Stanley was accused of fracturing the child’s skull again.

Defense attorney Adam Johnson asked Judge David Ritchie to make available the personnel records of Lt. Elizabeth Zaunbrecher, Patty Bailey and Katherine LeBlanc, all with the Calcasieu Parish Sheriff’s Office.

“We want the personnel files because we believe there may be exculpatory evidence in there for the defense,” Johnson said.

Ritchie said he wasn’t ready to turn over the records, but would look them over himself, in what is called an in-camera inspection.

“I’m happy with the ruling,” said attorney Stephen Dwight, who represents the Sheriff’s Office. “We protected the deputies’ privacy concerns.”

In 2007, video statements were taken by LeBlanc from Stanley and a man. The audio is not working, though, Johnson said.

Prosecutor Carla Sigler said efforts have been made to restore the audio.

Bailey questioned Stanley in 2009, again videotaped, but this time with working audio.

Ritchie said he was concerned about the lack of audio in the 2007 statements because reports filed based on the 2009 interview “did not properly characterize statements” made during questioning.

“That was very concerning to me,” the judge said.

The case is scheduled to return to trial in January.(MGNonline)
