A judge in state district court on Wednesday scheduled a hearing for next month to consider whether to quash a second-degree murder indictment against a man accused of killing a pastor in church.

Judge Clayton Davis set the hearing for 9 a.m. Dec. 30, requiring Calcasieu Parish District Attorney John DeRosier, prosecutor Hugo Holland, and former assistant district attorney Brett Sandifer to testify on the grand jury’s June 26 second-degree murder indictment for Woodrow Karey. Karey, 54, is accused of fatally shooting 53-year-old Ronald J. Harris at Tabernacle of Praise Worship Center in September 2013.

After reportedly shooting Harris twice at the church, Karey called law enforcement officers to turn himself in. Karey claimed that Harris raped his wife.

Todd Clemons and Adam Johnson, defense attorneys for Karey, said they already reached an agreement with the District Attorney’s Office that allowed the grand jury to determine the appropriate charge last November. After the grand jury “found that manslaughter was the appropriate charge,” Clemons said the District Attorney’s Office “reneged on that agreement.”

“What they did subsequent to that is file an enhancement and then, a few months later, they took the case back to a different grand jury, and indicted our client for second-degree murder without any opportunity to put forth any evidence,” he said.

Prosecutor Carla Sigler said there was no agreement between the District Attorney’s Office and the defense attorneys. “If there was an agreement, they would’ve pled guilty to manslaughter already,” she said. “That is not the case.”

Sigler said the District Attorney’s Office “received new information and new evidence” that was presented to the grand jury “in accordance with the law,” resulting in the second-degree murder indictment.

“The grand jury decided to return an indictment for second-degree murder, which is the correct charge in this case,” she said.
